Therapeutic Goods Amendment Act (No. 1) 2006 Implementation - General Principles

These Enforcement Guidelines describe and explain the enforcement provisions included in the Therapeutic Goods Act 1989 (the Act), as introduced by the Therapeutic Goods Amendment Act (No.1) 2006 (the 2006 Act).
These Enforcement Guidelines also provide a guide as to how sanctions set out in the Act will be enforced, including in relation to infringement notices and enforceable undertakings and the general principles of civil penalty proceedings as opposed to criminal prosecutions relating to breaches of the Act.
